Terms and Conditions

These terms govern your use of the eskademelding.no service provided by Cloda AS (Org. no. 832 573 612). By using eskademelding.no, you confirm that you have read, understood and accepted the terms.

1. Who we are

eskademelding.no is provided by Cloda AS, registered in Norway with organization number 832 573 612. Address: Toftes Gate 21A, 0556 Oslo. Contact: [email protected]

2. The eskademelding.no service

We offer a digital platform for filling out car accident reports. The service is provided 'as is'. We aim for high uptime and quality, but do not guarantee freedom from errors or interruptions.

3. Acceptance and changes

By using the service, you agree to these terms. We may update the terms with reasonable notice. Continued use after changes constitutes acceptance of the updated terms.

4. Account and security

You are responsible for protecting your login information and for all activity via your account. Notify us immediately if you suspect unauthorized use.

5. Permitted use

You may not: (a) violate applicable law, (b) attempt to bypass security, (c) copy, decompile or reverse engineer eskademelding.no where not permitted by law, or (d) use eskademelding.no in a way that harms other users or third parties.

6. Prices and payment

Any prices are shown before purchase. Payment is processed through Vipps (Vipps AS). The amount is reserved/charged in accordance with Vipps' routines upon confirmed purchase. Right of withdrawal and consumer rights follow Norwegian law and guidance from the Norwegian Consumer Authority for digital services.

Sales Terms

Parties

The service is provided by Cloda AS, organization number 832 573 612, with address Toftes Gate 21A, 0556 Oslo and email [email protected] (hereinafter "us" or "we"). The buyer is the party who pays for the service (hereinafter "you" or "buyer").

Payment

Payment is made via Vipps. The transaction is handled by Vipps under their terms. The amount is reserved/charged when the purchase is confirmed. A receipt is sent to the provided email and/or appears in the Vipps app. All prices include VAT where applicable.

Delivery

This is a digital service. Access is normally provided immediately after successful payment. Any information and receipts are made available in the app/website and/or sent by email.

Right of withdrawal

As a consumer you have a 14-day right of withdrawal from the day after the purchase. If delivery of digital content/service has begun with your express consent and you were informed that the right of withdrawal then lapses, the right may be limited. Contact us at [email protected] to exercise the right of withdrawal.

Return

There is no physical return for digital services. If the conditions for withdrawal or refund are met and the service has not been used, refunds are made within 14 days after we receive your request.

Complaint handling

Notify us within a reasonable time if the service does not function as agreed. We will correct errors within a reasonable time. If correction is not possible, a price reduction or termination may be relevant under applicable consumer rules.

Dispute resolution

Disputes should first be attempted resolved amicably through our customer service. Consumers may bring the case to the Norwegian Consumer Authority/Consumer Dispute Commission. Disputes may otherwise be brought before ordinary courts in Norway. Norwegian law applies.

7. Intellectual property rights

Rights to software, design and content belong to Cloda AS or our licensors. You are granted a limited, non-exclusive license to use eskademelding.no in accordance with these terms.

8. Limitation of liability

To the extent permitted by law, our liability is limited to direct losses you document as a result of material breach. We are not liable for indirect losses, consequential damages or loss of data, unless otherwise follows from mandatory law.

9. Termination

You may stop using the service at any time. We may close or suspend access in case of breach of terms or misuse of eskademelding.no.

10. Governing law and disputes

These terms are governed by Norwegian law. Disputes should first be sought resolved amicably. If not, the case may be brought before ordinary courts in Norway.
